Terms of Service

CrewKeep is a service operated by CrewKeep (ABN 34 580 154 022). Mailing address: Sydney, NSW, Australia.

These terms govern your use of CrewKeep ("we", "us", "the product"). By signing up or using the product you agree to these terms.

1. The product

CrewKeep is a software tool for Australian construction subcontractors. The product is software. It's not financial product advice, legal advice, or tax advice. We don't hold an AFSL.

2. Account and eligibility

You must be 18 or older, operate or work for an AU business with an active ABN, and be authorised to enter into these terms.

3. Subscription tiers and billing

Tiers: Free, Lite (~$29/mo), Pro (~$99/mo), Premium (~$149/mo). Annual billing saves ~2 months. All prices inclusive of GST. We charge via Stripe; tax invoices are issued automatically. Subscriptions renew until cancelled.

Cancel any time via the customer portal — takes effect at end of current billing period; you revert to Free, your data is preserved. The head contractor health check is a $50 transactional add-on; Pro and Premium subscribers get one free check per calendar month.

4. Acceptable use

You agree not to use the product to harass, defame, or unlawfully harm any third party; not to republish health check reports or AMR results outside your business without permission; not to resell, sublicense, or share account access; not to attempt to reverse-engineer, scrape, or extract our data; not to use the product to generate fraudulent communications; not to circumvent tier gates or rate limits.

5. Public-source data

Public-source data (ATO disclosed business tax debts, ASIC public records, court filings, regulator licence databases) is factual as of the relevant data refresh date. We don't guarantee accuracy or currency. Decisions you make in reliance on it are yours.

6. AI features

Your AI assistant queries are sent to Anthropic for processing. We don't use your AI conversations to train models. AI responses are software-generated and aren't financial, legal, or tax advice.

7. Health check reports

Reports are generated from public-source data. Use for internal decision-making only. Don't republish or share outside your business. Don't represent reports as advice or guarantees.

8. SOPA payment claims (when unlocked)

Generated payment claims are formatted to the relevant state's Security of Payment Act. Templates are reviewed by a SOPA-specialist lawyer before production release. You're responsible for verifying before serving and complying with service requirements under the Act.

9. Refunds

Subscription fees aren't refunded for partial periods. Health check transactional charges are non-refundable once the report is generated, unless the data is materially incorrect — in which case we'll regenerate at no additional cost.

10. Liability

The product is provided "as is" without any guarantee of accuracy, fitness for purpose, or uninterrupted availability. We aren't liable for indirect, consequential, or special losses. Our aggregate liability is limited to fees paid in the prior 12 months. Nothing limits liabilities that can't be limited under Australian Consumer Law.

11. Termination

We may suspend or terminate your account for breach, non-payment, or unlawful use. You may delete your account from Settings; deletion is reversible for 30 days, then your data is permanently removed (audit records retained as evidentiary trail).

12. Changes

Material changes to the product or these terms will be notified to active users at least 30 days before they take effect.

13. Governing law

These terms are governed by the law of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of NSW.
